Kenpong Travel rejects First Atlantic Bank's winding-up petition

Kenpong Travel and Tours Limited has strongly rejected a reported attempt by First Atlantic Bank to wind up the company over an alleged GH¢2.5 million debt. Through its legal representatives Zoe, Akyea & Co., the company has described the bank's action as premature, malicious and damaging to its reputation during a critical period when it is providing travel services linked to the FIFA World Cup.

The travel firm raised concerns about procedural irregularities in the bank's approach. Kenpong stated it had not been formally served with any winding-up petition allegedly filed on 4 May 2026, yet details of the purported petition had already appeared in public discourse before official service. The company's lawyers questioned this unusual sequence and argued that key facts had been omitted from public reports.

Pending appeal halts proceedings

Central to Kenpong's defence is an ongoing appeal at the Court of Appeal challenging the underlying judgment on which the bank's debt claim is based. The company secured a summary judgment against Kenpong in August 2022, but the travel firm immediately appealed. Kenpong contends the bank's winding-up application is filed in bad faith, as the appellate court has not yet ruled on the validity of the original judgment or confirmed the amount in dispute.

Kenpong Travel has also disclosed a separate legal action against both First Atlantic Bank and the Bank of Ghana over what it describes as the bank's refusal to provide account statements it has requested.
