Court Must Balance Rule of Law with Press Freedom, Says Suame MP on Herald Editor Case

Suame Member of Parliament John Darko has called for a careful balance between upholding court orders and protecting Ghana's press freedom, following a recent court decision involving Larry Dogbe, Managing Editor of The Herald newspaper.

Mr Dogbe was granted a conditional 10-day bail after his legal team successfully stayed execution of a custodial sentence through an ex parte application. Speaking on JoyNews' Newsfile on Saturday, June 27, Mr Darko expressed support for the judge's ruling, emphasising that judicial authority must be respected to preserve the rule of law. "I think that is a very good position the judge has taken," he said, noting he would have made the same decision.

However, Mr Darko stressed that whilst court orders must be obeyed, Ghana's courts have generally shown strong commitment to safeguarding media freedom. He cautioned against viewing the ruling as a blanket attack on the press, explaining it concerns an individual journalist's conduct rather than institutional restrictions. "It is not a general statement," he said, suggesting the case must be understood within the context of prior interactions between the individual and the courts.

The MP warned that media practitioners must exercise responsibility and respect legal boundaries, as repeated disregard for court directives could ultimately undermine journalists' credibility and safety. He expressed concern about custodial sentences for media workers, arguing that imprisonment should be a last resort given journalism's vital democratic role. "I really hope that this gentleman will not end up in jail then we all learn from it," Mr Darko stated.

He emphasised that Ghana's democracy depends critically on a free and independent media, describing it as essential for accountability and good governance. "Our media is so critical for our democracy and we ought to do everything to protect it," he concluded, calling for continued efforts to safeguard journalistic freedom whilst ensuring legal compliance.
