EOCO detains Manhyia MP Baffour Awuah after lengthy questioning; Minority decries arrest procedures

The Economic and Organised Crime Office (EOCO) has detained Manhyia South Member of Parliament Nana Agyei Baffour Awuah following his voluntary surrender on Thursday, October 1. The arrest has sparked fresh criticism from the Parliamentary Minority, which questions the agency's handling of the case.

According to Minority Leader Alexander Afenyo-Markin, who visited the detained MP in custody, Mr Awuah arrived at EOCO headquarters at 10:47 a.m. accompanied by his legal team and parliamentary colleagues. Despite being assured he would be seen within 15 minutes, the MP waited three to four hours before interrogation commenced after 2 p.m.

"That 15 minutes turned into some 3 or 4 hours," Afenyo-Markin told reporters on Friday, October 2, highlighting what the Minority views as deliberately prolonged procedures.

Sequence of events and the arrest

After another 30-minute wait, EOCO officials asked Mr Awuah to complete a personal profile form. Investigators then departed to seek clearance from the Director of Operations before returning to question the MP about his law firm's 2018 handling of a SIC Life case. The overview was completed by approximately 4 p.m., at which point officials formally arrested the MP.

The Minority Leader characterised this timing as suspicious, noting that EOCO only announced the arrest after Mr Awuah had already cooperated fully with questioning. "They officially tapped his shoulders and said he was under arrest. So, to them, it was at 4 pm after all of that that they effected an arrest," Afenyo-Markin said.

EOCO subsequently conducted a search of Mr Awuah's law office in Dzorwulu. According to Afenyo-Markin, the search yielded no documents directly related to the investigation, though officials allegedly removed unrelated materials including vehicle documents.

The MP was returned to EOCO at 7:30 p.m., where he waited approximately one hour before investigators informed him of his detention. He was moved to cells at 8 p.m., despite objections from his lead counsel, Samuel Atta Akyea. On Friday morning, EOCO indicated plans to search his residence and suggested bail could be granted by midday, but no investigator attended to him until after 2 p.m.

Why it matters for Ghana

The case raises important questions about due process and arrest procedures in Ghana's legal system. The timing and manner of Mr Awuah's arrest—occurring only after hours of cooperative questioning—has led the Minority to question whether EOCO followed proper investigative protocols. The allegations against the MP involve suspected financial loss, dissipation of public funds, and money laundering related to SIC Life Savings and Loans transactions, matters of significant public interest.

The detention also underscores ongoing concerns about the treatment of high-profile detainees and the independence of investigative agencies. As a sitting MP, Mr Awuah's case involves parliamentary privilege considerations that may require careful handling. The Minority's documented concerns about procedural irregularities suggest this case will likely become a focal point in debates about accountability, transparency, and fair treatment within Ghana's law enforcement apparatus.

EOCO's handling of the arrest and subsequent detention will likely face scrutiny in Parliament and among civil society organisations focused on due process and human rights.

Background on the investigation

Mr Awuah voluntarily reported to EOCO after the Accra High Court issued a warrant for his arrest. The investigation centres on transactions involving SIC Life Savings and Loans and remains ongoing. The case forms part of broader investigations into financial irregularities that have drawn public attention and Parliamentary oversight.
