Court halts NPP Bibiani-Anhwiaso-Bekwai constituency elections pending legal challenge

The Sefwi Wiawso High Court in Ghana's Western North Region has issued an injunction blocking the New Patriotic Party's planned constituency executive elections in Bibiani-Anhwiaso-Bekwai, originally scheduled for Saturday, July 11, 2026. The court order came after seven party members aspiring to various positions within the constituency filed an interlocutory injunction application challenging the electoral process.

The legal action names multiple defendants, including the NPP National Chairman, the party's Director of IT, the constituency election committee chairman, the Western North Regional Chairman, the constituency chairman, and both the Regional and District Directors of the Electoral Commission in Bibiani. The breadth of defendants suggests the complainants are raising concerns about the conduct and management of the electoral process at multiple levels of party and state authority.

What the court proceedings reveal

During the second hearing before Justice Oliver Atsu Abada, the court considered competing arguments about whether the case should proceed. Benjamin Armah filed an affidavit requesting that the suit be struck out, arguing the applicants had abused the court process and failed to exhaust internal NPP dispute resolution mechanisms before resorting to litigation. This is a common procedural defence in party-related electoral disputes, reflecting the principle that political parties are expected to resolve internal conflicts through their own mechanisms first.

However, the court rejected this argument. Justice Abada dismissed the motion to strike out the suit, effectively allowing the legal challenge to continue. The court then granted the 4th Defendant additional time to file a formal response to the interlocutory injunction application, indicating the case has substance and merits further consideration.

Why it matters for Ghana

Internal party elections are a critical component of Ghana's democratic process. These constituency-level contests determine which candidates will represent their parties in parliamentary and local elections, shaping the political landscape for years to come. When disputes arise over the fairness or transparency of such elections, court intervention becomes necessary to protect the rights of party members and ensure electoral integrity.

This case reflects broader concerns about internal party governance in Ghana. The involvement of multiple institutional actors—from party leadership to Electoral Commission officials—suggests that questions may extend beyond simple procedural irregularities to encompass systemic issues in how party elections are conducted and overseen. For the NPP, a major governing party, any legal challenge to its internal electoral processes carries implications for party unity and institutional credibility.

The injunction also demonstrates the role Ghana's courts play in adjudicating political disputes. By pausing the elections, the court has provided space for the issues to be thoroughly examined rather than allowing elections to proceed under contested circumstances, which could undermine the legitimacy of whoever wins office.

The merits of the case are scheduled for hearing on Friday, July 17, 2026, giving both the plaintiffs and the party machinery an opportunity to present full arguments before the court reaches a final decision on whether the elections may proceed.
